Dear Friends,

Several weeks ago at the World of Coal Ash Conference in Lexington, KY, I had the opportunity to speak with many of you regarding my efforts in Washington to protect the beneficial reuse of coal ash and stop the EPA from regulating it as a hazardous material. It was a welcome opportunity to speak with others who share a passion for this issue and thank you for the feedback you provided.

Since that time I have introduced bipartisan legislation (H.R. 2218, “Coal Residuals Reuse and Management Act of 2013”)with 35 original co-sponsors, including 10 Democrats. The plan offers a common sense alternative to the proposal to regulate coal ash as a hazardous material by setting up federal standards that are managed by the states. This legislation improves upon the bill that passed the House four times in 2011 and 2012.

After meeting with various stakeholder groups, we incorporated several changes that address concerns from the EPA and environmental groups. We are pleased that the EPA appears to be willing to work to find a solution rather than opposing the legislation as they have in the past.

Last week the Subcommittee on Environment and the Economy advanced the bill unanimously without any changes. Hopefully this is a sign of consensus on this issue.
